Terms and Conditions for Mood Journal

1. Introduction

Welcome to Mood Journal ("we," "our," "us," or "the App"). These Terms and Conditions ("Terms") govern your access to and use of the Mood Journal mobile application, including mood tracking, habit and routine tracking, journaling, and meditation features (collectively, the "Services").

By downloading, installing, or using Mood Journal, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Mood Journal. By using the App, you confirm that you meet this requirement. If you are using the App on behalf of a minor, you are responsible for ensuring their use complies with these Terms.

3. Description of Services

Mood Journal provides:

  • Mood logging with intensity tracking and activity tagging
  • Habit and routine tracking with streak monitoring
  • Journaling and daily reflection tools
  • Guided meditation content
  • Avatar customization

Mood Journal is a personal wellness and self-reflection tool. It is not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment.

4. Not Medical Advice

Mood Journal is intended for general self-awareness and personal wellbeing purposes only. It does not:

  • Diagnose, treat, cure, or prevent any mental health condition or disease
  • Replace consultation with a licensed therapist, counselor, psychiatrist, or physician

If you are experiencing a mental health crisis, thoughts of self-harm, or a medical emergency, please contact a licensed professional or your local emergency services immediately. Use of the App does not create a therapist-patient or doctor-patient relationship.

5. User Content

"User Content" means any mood logs, journal entries, habit data, or other content you create within the App.

  • You retain ownership of your User Content.
  • Because Mood Journal stores your data locally on your device by default, you are responsible for backing up your own data. We are not responsible for data loss due to device damage, loss, factory reset, or app uninstallation.
  • You agree not to use the journaling or notes features to store or transmit unlawful, threatening, abusive, or infringing content.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to reverse-engineer, decompile, or modify the App's code
  • Interfere with or disrupt the App's functionality or servers (if applicable)
  • Use automated means (bots, scrapers) to access the App
  • Misrepresent your identity or impersonate another person or entity within the App

7. Intellectual Property

All content, features, design elements, illustrations, branding, and functionality within Mood Journal (excluding your own User Content) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, or create derivative works from the App without our prior written permission.

8. Third-Party Services

Mood Journal may use third-party services (such as app store platforms, crash reporting tools, or content libraries for meditation music). Your use of such integrated services may be subject to the third party's own terms, and we are not responsible for their practices.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE AT ALL TIMES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms. You may stop using the App and uninstall it at any time.
